Loyalty Programme Regulations

§1. General provisions

1. These Regulations, hereinafter the "Regulations", set out the rules for participation in the loyalty programme addressed to customers of the online stores:
The Regulations define the rules for awarding loyalty points, granting discounts, and using and cancelling points awarded in connection with the purchase of products.
2. The Loyalty Programme is organised through the online stores indicated in point 1, which are owned and administered by the Organiser.
3. The Organiser of the "Bemo" Loyalty Programme (hereinafter: the "Programme") is Etcorn Sp. z o.o. Sp. k., with its registered office in Tarnów, ul. Dojazd 1, 33-100 Tarnów, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register, under number:

(hereinafter: the "Organiser").
4. Participation in the Programme is voluntary and available only to registered users of the Organiser's sales platforms.
5. The Programme runs from the date of its publication on the Organiser's website until it is withdrawn; the date of withdrawal will be communicated by the Organiser to participants at least 1 month in advance by means of information posted on the Organiser's websites.

7. The Programme is conducted in the territory of Poland.

§2. Conditions of participation

1. Participation in the Loyalty Programme is free of charge and entirely voluntary.
2. Before joining the Loyalty Programme, the Participant is obliged to read these Regulations.
3. Any natural or legal person may be a Participant in the Programme if they:
have an active customer account in one of the Organiser's online stores indicated in § 1(1) of these Regulations,
have accepted these Regulations,
make purchases on their own account.
4. A Participant may take part in the Programme only in person, and their participation cannot be transferred to other persons.
5. Each Participant may have only one account in the Loyalty Programme run by the Organiser.
6. A Participant can check their Account Balance in their Customer Account.
7. A Participant in the loyalty programme is obliged to provide data that are true and correct. If the data provided change, the Participant is obliged to update them.
8. The Organiser reserves the right to refuse participation to, or exclude, a Participant in the event of a breach of these Regulations.

§3. Rules for awarding points

1. Points are awarded depending on the value of the products purchased, in accordance with the following rules:
Each Product has a specific point value assigned to it.
1 Point = PLN 0.05 net (5 grosz) of discount
2. Points are awarded only for products that have a point value assigned, as indicated in the product description.
3. Points are not awarded for:
shipping costs,
products excluded from the programme, as indicated on the product page.
4. Points awarded to a Participant by the Organiser are cumulative.
5. In the event of withdrawal from the contract or the return of the products for which points were awarded, those points will be cancelled.
6. A Participant can check the number of points collected after logging in to their account, in the "Loyalty Programme" section.
7. The Organiser reserves the right to award additional points as part of special promotions and marketing campaigns – the rules of such promotions will be set out separately each time.
8. Points expire 365 days after the date on which they were awarded if they have not been used within that time.

§4. Exchanging points for discounts

1. Points collected in the Programme may be exchanged for discounts on subsequent purchases.
2. The minimum number of points needed to use a discount is 100 points.
3. The discount may only be redeemed on an order with a minimum value of PLN 149 net.
4. The value of the discount is calculated automatically according to the rule:
1 Point = PLN 0.05 net (5 grosz)
5. To receive Points, the Participant making a Purchase should be logged in to their Account in the Organiser's Online Store.
6. Points may be used only by the Participant who collected them – they cannot be transferred, sold or exchanged for cash.
7. The number of available points and the transaction history are visible after logging in, in the "Loyalty Programme" section.
8. The Organiser has the right to correct a Participant's Account Balance if points have been awarded incorrectly.

§5. End of participation in the programme and end of the programme

1. A Participant may at any time withdraw from the Programme and terminate the agreement by submitting a written statement to the Organiser's registered office address or by sending a statement to the Organiser's e-mail address.
2. For important reasons, the Organiser may suspend or terminate a Participant's participation in the Programme and terminate the agreement. The following are considered important reasons within the meaning of the previous sentence:
making the Account available to an unauthorised person,
abuse or other breaches of the Regulations.
The notice of termination must state the reason for terminating participation in the Programme.
3. The Organiser may suspend or end the Programme. Participants will be informed of this no later than 1 month before the Programme is suspended or ended. This information will be published on the website of the Organiser's Online Store.
4. Upon withdrawal from the Programme or the expiry of the notice period, the agreement for participation in the Programme is terminated. A Participant who intends to withdraw from the Programme should first use the Points they have collected.

§6. Complaints

1. Complaints (in particular objections concerning the number of Points awarded) should be submitted to the Organiser:

2. The complaint should include:
first name and surname,
the address of the person or entity submitting the complaint,
telephone number and e-mail address,
a detailed description of and reason for the complaint.
3. The Organiser will consider the complaint without undue delay, no later than within 14 days of its receipt.
4. The Organiser will inform the person submitting the complaint of its outcome within the above time limit, in writing or by e-mail to the address given in the complaint, depending on how the complaint was submitted.

§7. Personal data

1. The controller of the Participants' personal data is the Organiser.
2. Your personal data will be processed for the purpose of participation in the Loyalty Programme, including, among other things, sending the Participant information about changes in the Account Balance and opportunities to earn additional points.
3. The Organiser will process the following personal data:
first name and surname,
e-mail address,
telephone number,
address.
4. The legal basis for processing the data is your consent (Article 6(1)(a) GDPR).
5. Providing the data is voluntary but necessary to take part in the Loyalty Programme.
6. For further information on how we process personal data, you can contact us via the Organiser's e-mail address.
7. Your data will be accessible to our employees and to employees of entities cooperating with ETCORN Sp. z o.o. Sp. k. that operate IT systems.
8. Your data will be stored for 1 year after the end of the Loyalty Programme.
9. You have the right to:
1) request access to your personal data, their rectification, erasure or restriction, as well as the right to object to processing and the right to data portability;
2) withdraw your consent to the processing of personal data by sending an e-mail to the Organiser's address. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal;
3) lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) concerning our processing of your personal data.
10. Your data will not be used for profiling or automated decision-making.
11. If a participant withdraws from the programme, their personal data are deleted.

§8. Final provisions

1. The Organiser reserves the right to amend these Regulations at any time, provided that the amendments do not infringe rights already acquired by Participants.
2. Information about an amendment to the Regulations will be provided to Participants by e-mail and by means of a notice on the shopping platform.
3. If, within 14 days of the announcement of the amendments, a Participant does not report that they do not accept them, the Participant is deemed to have accepted the amendments. Participants who do not accept the amendments to the Regulations will no longer be able to use the Programme, but will be able to use the points they have collected on the existing terms.
4. The Organiser has the right to end the Programme at any time, subject to 1 month's notice. In such a case, points collected may be used during the notice period, after which they expire.
5. In matters not regulated by these Regulations, the provisions of the Polish Civil Code and other relevant provisions of Polish law shall apply.
6. The Loyalty Programme is not a game of chance, in particular a raffle, a promotional lottery whose outcome depends on chance, a mutual bet, or any other form to which the provisions of the Polish Act of 19 November 2009 on Gambling (consolidated text: Journal of Laws of 2025, item 595) apply.
7. The Regulations enter into force on the date of their publication on the Organiser's website.
